  • While we make reasonable efforts to verify property information, we do not guarantee the accuracy, completeness, or authenticity of any property listing, title, or documentation provided by third parties.

  • All transactions are subject to the applicable laws of India, including the Real Estate (Regulation and Development) Act, 2016 (RERA) where applicable.

3. Eligibility

  • You must be at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872.

  • By engaging with us, you represent and warrant that the information provided to us is accurate, truthful, and complete.

4. User Obligations

When engaging with our Services, you agree:

  • To provide accurate, current, and complete information during property enquiries, negotiations, and transactions.

  • Not to use the Services for unlawful, fraudulent, or misleading purposes.

  • To comply with all applicable laws, including property, tenancy, stamp duty, registration, and tax laws.

  • To independently verify property details, legal documents, and ownership before entering into any binding agreement.

5. Fees and Payments

  • Our brokerage/consultancy/service charges shall be as mutually agreed in writing before finalisation of any property transaction.

  • Payments made to us are non-refundable unless expressly agreed otherwise.

  • You agree to make timely payments of applicable fees, commissions, and charges.

6. Limitation of Liability

  • We act solely as facilitators and are not responsible for disputes between buyers, sellers, tenants, or landlords.

  • We are not liable for:

    • Defects in property title, ownership disputes, encumbrances, or fraud by third parties.

    • Any financial loss, damages, or inconvenience caused by misrepresentation of property details by third parties.

  • Our liability, if proven, shall be limited to the service fee actually paid to us in connection with the specific transaction.

7. Privacy and Data Protection

We are committed to protecting your personal information in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) of India.

7.1 Data We Collect

  • Contact details (name, phone number, email, WhatsApp number, address).

  • Property preferences and requirements.

  • Transaction-related information.

7.2 Use of Data

By providing your personal information, you consent to its collection, processing, storage, and use by us for the following purposes:

  • To contact you in relation to property listings, services, and transactions.

  • To provide you with updates, offers, and promotional material relating to our services.

  • To comply with legal obligations, including anti-money laundering (AML) and Know Your Customer (KYC) requirements.

7.3 Communication Consent

By agreeing to these Terms, you expressly consent to being contacted by Padmaj Services LLP through:

  • SMS

  • Any other mode of communication permitted by law.
